1. Introduction and Agreement to Terms

3. User Eligibility and Registration

5. Prohibited Activities

You expressly agree not to:

a) Use our services for any illegal, fraudulent, or unauthorized purpose.

b) Submit false, inaccurate, or misleading information.

c) Request services for obtaining documents through means that circumvent official requirements or procedures.

d) Attempt to manipulate the application process or outcomes through misrepresentation or omission of relevant information.

e) Use our services to interfere with or disrupt any government process or system.

f) Infringe upon the intellectual property rights of the Company or third parties.

g) Access, tamper with, or use non-public areas of the Website or our computer systems.

h) Introduce viruses, trojans, worms, or other malicious code to the Website.

i) Attempt to probe, scan, or test the vulnerability of our systems or networks.

j) Impersonate another person or misrepresent your affiliation with any person or entity.

6. Fees and Payment

a) All service fees are clearly displayed on our Website and are subject to change. The fee applicable at the time of service request will be the fee charged.

b) Payment must be made in advance before we begin processing your application.

c) All fees are non-refundable once service processing has begun, except as specifically provided in our refund policy or as required by applicable law.

d) Service fees do not include any government fees, taxes, or charges that may be required for your application. These additional costs, if any, will be clearly communicated to you.

e) We accept payment through the methods specified on our Website. You agree to provide accurate payment information and authorize us to charge the applicable fees to your selected payment method.

7. Service Processing and Timeframes

a) Estimated processing times are provided for informational purposes only and are not guarantees. Actual processing times may vary based on government procedures, volume of applications, and other factors beyond our control.

b) We will make reasonable efforts to process your application expeditiously and keep you informed of its status.

c) We are not responsible for delays caused by government agencies, incomplete submissions, additional verification requirements, or other circumstances beyond our control.

d) In case of unusual delays, we will communicate with you and work to resolve any issues that may be causing the delay.

8. Cancellations and Refunds

a) Cancellation requests must be submitted in writing to our customer service department immediately after placing an order.

b) If we have not yet begun processing your application, we may issue a refund minus an administrative fee as specified in our refund policy.

c) Once we have begun processing your application (including document preparation or submission), refunds will be limited to circumstances where we have failed to provide the agreed-upon services.

d) No refunds will be issued based on the outcome of an application. Our service fee is for processing assistance and does not guarantee approval by government authorities.

e) In the event of service cancellation by us due to incomplete information, fraudulent documents, or violation of these Terms, no refund will be issued.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

a) PHILIPPINES POLICE CLEARANCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

i. YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; ii. ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; iii. DELAYS OR DENIALS BY GOVERNMENT AGENCIES; iv. ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR SUBMISSIONS OR CONTENT; OR v. ANY OTHER MATTER RELATING TO THE SERVICES.

b) OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR OUR SERVICES IS LIMITED TO THE AMOUNT PAID BY YOU TO PHILIPPINES POLICE CLEARANCE FOR THE SERVICES GIVING RISE TO THE CLAIM.

c) THE LIMITATIONS OF THIS SECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE.

10. Disclaimers

a) THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

b) PHILIPPINES POLICE CLEARANCE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

c) PHILIPPINES POLICE CLEARANCE DOES NOT GUARANTEE THE OUTCOME OF ANY APPLICATION OR REQUEST SUBMITTED TO GOVERNMENT AGENCIES, AS THESE DECISIONS ARE MADE SOLELY BY THE RELEVANT AUTHORITIES.

d) NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM PHILIPPINES POLICE CLEARANCE OR THROUGH THE SERVICES, SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

11. Indemnification

You agree to defend, indemnify, and hold harmless Philippines Police Clearance, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from:

a) Your use of and access to the services;

b) Your violation of any term of these Terms;

c) Your violation of any third-party right, including without limitation any copyright, property, or privacy right;

d) Any claim that information you submitted caused damage to a third party; or

e) Any misrepresentation made by you.

This defense and indemnification obligation will survive these Terms and your use of the services.

12. Intellectual Property

The Website, its original content, features, and functionality are owned by Philippines Police Clearance and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not copy, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of the material on our Website without prior written consent.

Any disputes arising from these Terms or your use of our services shall be resolved exclusively in the courts of proper jurisdiction in Metro Manila, Philippines.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes by posting the new Terms on the Website and updating the “Last Updated” date.
